These Terms and Conditions (“Terms”) govern your use of the website located at edulutionsafrica.co.za (“Site”) and any services provided by Edulutions Africa (Pty) Ltd(“Edulutions Africa”, “we”, “us”, or “our”). By accessing the Site or engaging our services, you agree to be bound by these Terms. If you do not agree, please do not use the Site or our services.

Edulutions Africa (Pty) Ltd is a South African private company registered under the Companies Act 71 of 2008 (Registration number to be confirmed), with its principal place of business at 46 Hoheizen Street, Bellville, 7530, Cape Town, South Africa. We operate across commodity trading, export logistics, consulting and BEE advisory, waste management, tool hire, and ICT solutions.
2. Use of the Website
You may use this Site for lawful purposes only. You must not:
- use the Site in any way that breaches applicable South African law or regulation;
- transmit unsolicited commercial communications (spam);
- attempt to gain unauthorised access to any part of the Site or its underlying systems;

3. Services and Quotations
Information presented on this Site regarding our services is for general information purposes only and does not constitute a binding offer. All services are subject to a formal written agreement or accepted quotation.
Quotations provided by Edulutions Africa are valid for the period stated therein, or where no period is stated, for 30 days from the date of issue. We reserve the right to withdraw or revise any quotation before formal acceptance.
Pricing is subject to change. Applicable taxes, including VAT at the prevailing rate, will be disclosed in writing prior to any engagement.
4. Payment Terms
Unless otherwise agreed in writing, payment terms are as set out in the relevant service agreement or invoice. Overdue accounts may attract interest at the rate permitted under the Prescribed Rate of Interest Act 55 of 1975, as amended. Edulutions Africa reserves the right to suspend services on accounts that remain unpaid beyond agreed terms.
5. Intellectual Property
All content on this Site — including text, graphics, logos, images, and software — is the property of Edulutions Africa or its content suppliers and is protected by South African and international intellectual property laws. The Edulutions Africa name and logo are trademarks of the company. Nothing on this Site grants any licence to use our intellectual property without prior written authorisation.

This Site may contain links to third-party websites. These links are provided for convenience only. Edulutions Africa does not endorse, control, or accept responsibility for the content, privacy practices, or accuracy of any third-party site. You access such sites at your own risk.
7. Disclaimer of Warranties

To the fullest extent permitted by law, Edulutions Africa disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. 8. Limitation of Liability
To the maximum extent permitted by South African law, Edulutions Africa shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or our services, even if advised of the possibility of such damages. Our total aggregate liability to you in connection with any claim shall not exceed the amount paid by you to us in the three months preceding the event giving rise to the claim.

9. Indemnity
You agree to indemnify and hold harmless Edulutions Africa, its directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Site, your breach of these Terms, or your violation of any law or third-party right.
10. Privacy
Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Site, you consent to the processing of your personal information as described in the Privacy Policy, in compliance with the Protection of Personal Information Act 4 of 2013 (POPIA).
11. Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of South Africa. Any dispute arising from or relating to these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts of the Western Cape Division of the High Court of South Africa, without prejudice to Edulutions Africa's right to seek urgent or interim relief in any competent court.
